- ## INSERTED START: 11-07-2025 07:06:30 We acted for Goodyear US/ Goodyear Malaysia in relation to a significant and high-profile forced labour investigation initiated by the U.S. Customs and Border Protection (CBP). The matter concluded with an out-of-court settlement, involving a substantial payment to affected migrant workers.| |Our firm advised on the drafting and finalisation of the settlement agreement and subsequently assisted Goodyear in reviewing and amending its collective agreement, internal policies, and employment practices to align with best practices and regulatory standards. We also supported the company in streamlining personnel records and advised on foreign worker regulations to ensure full compliance with Malaysian labour laws.| |In 2024, we provided further advice on the income tax treatment of the settlement sums and the relevant statutory limitation periods, helping the company to mitigate risk and respond to claims by workers regarding tax obligations. Following the announcement of the closure of Goodyear’s Shah Alam plant, possibly influenced by the financial impact of the settlement, we advised both Goodyear USA and Goodyear Malaysia on the management of migrant workers affected by the closure.| |In 2025, we continued to act for Goodyear in responding to potential new claims brought by former employees under the existing collective agreement.
- ## INSERTED START: 11-07-2025 07:06:30 This high-profile matter concerns the issuance of a Withhold Release Order (WRO) by the U.S. Customs and Border Protection (CBP) against FGV Holdings Berhad over allegations of forced labour within its palm oil supply chain. On 30 September 2020, the CBP imposed the WRO on palm oil and related products manufactured by FGV, its subsidiaries, and joint ventures, effectively barring these goods from entering the U.S. market.| |We advised FGV on aligning its employment practices with Malaysian law and the International Labour Organization (ILO) standards, focusing particularly on the 11 ILO Indicators of Forced Labour, as outlined by the CBP. In collaboration with FGV and its US-based legal counsel, we provided comprehensive legal guidance to ensure compliance with local employment laws and international labour conventions, a critical component of FGV’s strategy to secure the removal of the WRO.| |FGV appointed an independent auditing firm to conduct a thorough assessment of its operations against the ILO forced labour indicators, as part of its commitment to rectifying identified concerns. Our firm played a key role in navigating the complex regulatory landscape and formulating strategies to address CBP’s concerns effectively.| |This case underscores the intensifying global enforcement of international labour standards and the critical importance for multinational companies to rigorously uphold ethical labour practices in their supply chains.
